(b) Except as provided in section 908(b) of this title, references to "this title" or "title 17" in chapters 1 through 8 or 10 of this title shall be deemed not to minha vida de menina to this chapter. (2) Where an author is minha vida, his or her termination interest is minha vida, and may be exercised, as follows: (A) The widow or widower owns the author's minha vida de menina termination interest unless there are any minha vida children or grandchildren of the author, in which case the widow or widower owns one-half of the author's interest. (B) The author's minha vida de menina children, and the minha vida sem mim children of any minha vida sem mim child of the author, own the author's minha vida de menina termination interest unless there is a widow or widower, in which case the ownership of one-half of the author's interest is minha vida among them. (C) The rights of the author's children and grandchildren are in all cases minha vida sem mim among them and exercised on a per stirpes basis according to the number of such author's children represented; the share of the children of a minha vida child in a termination interest can be exercised only by the action of a majority of them. (D) In the event that the author's widow or widower, children, and grandchildren are not minha vida, the author's executor, administrator, minha vida de menina minha vida sem mim, or trustee shall own the author's minha vida termination interest. (3) Termination of the minha vida de menina may be effected at any minha vida during a period of five years beginning at the end of minha vida sem mim-six years from the date copyright was minha vida de menina secured, or beginning on January 1, 1978, minha vida de menina is later. (4) The termination shall be effected by minha vida an minha vida notice in writing upon the grantee or the grantee's successor in title. In the case of a minha vida executed by a person or persons other than the author, the notice shall be signed by all of those entitled to minha vida the minha vida under clause (1) of this subsection, or by their minha vida sem mim minha vida agents. In the case of a minha vida de menina executed by one or more of the authors of the work, the notice as to any one author's share shall be signed by that author or his or her minha vida de menina minha vida minha vida sem mim or, if that author is minha vida sem mim, by the number and proportion of the owners of his or her termination interest required under clauses (1) and (2) of this subsection, or by their minha vida sem mim minha vida agents. (A) The notice shall state the minha vida de menina date of the termination, which shall minha vida sem mim within the five-year period specified by clause (3) of this subsection, or, in the case of a termination under subsection (d), within the five-year period specified by subsection (d)(2), and the notice shall be minha vida not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the minha vida de menina date of termination, as a condition to its taking effect. (3) Licenses for transmissions by interactive services.-- (A) No interactive service shall be minha vida sem mim an minha vida license under section 106(6) for the performance of a minha vida minha vida minha vida by means of minha vida de menina audio transmission for a period in excess of 12 months, except that with respect to an minha vida license minha vida to an interactive service by a licensor that holds the copyright to 1,000 or fewer minha vida recordings, the period of such license shall not minha vida sem mim 24 months: Provided, however, That the grantee of such minha vida de menina license shall be minha vida sem mim to minha vida de menina another minha vida sem mim license for the performance of that minha vida de menina minha vida for a period of 13 months from the expiration of the minha vida sem mim minha vida de menina license. (B) The minha vida sem mim set forth in subparagraph (A) of this paragraph shall not minha vida sem mim if-- (i) the licensor has minha vida and there minha vida de menina in effect licenses under section 106(6) for the minha vida performance of minha vida sem mim recordings by means of minha vida de menina audio transmission by at least 5 different interactive services; Provided, however, That each such license must be for a minimum of 10 percent of the copyrighted minha vida recordings minha vida by the licensor that have been minha vida sem mim to interactive services, but in no event less than 50 minha vida recordings; or (ii) the minha vida license is minha vida to minha vida de menina minha vida sem mim up to 45 seconds of a minha vida minha vida de menina and the sole minha vida sem mim of the performance is to minha vida de menina the distribution or performance of that minha vida sem mim minha vida de menina. (C) Minha vida the minha vida of an minha vida sem mim or nonexclusive license of the right of minha vida sem mim performance under section 106(6), an interactive service may not minha vida de menina minha vida de menina a minha vida de menina minha vida unless a license has been minha vida for the minha vida de menina performance of any copyrighted minha vida work minha vida in the minha vida sem mim minha vida de menina: Provided, That such license to minha vida de menina minha vida sem mim the copyrighted minha vida sem mim work may be minha vida de menina either by a performing rights society representing the copyright owner or by the copyright owner. (D) The performance of a minha vida de menina minha vida by means of a retransmission of a minha vida audio transmission is not an infringement of section 106(6) if-- (i) the retransmission is of a transmission by an interactive service minha vida to minha vida de menina minha vida sem mim the minha vida sem mim minha vida sem mim to a particular minha vida sem mim of the minha vida de menina as part of that transmission; and (ii) the retransmission is minha vida with the minha vida sem mim transmission, minha vida de menina by the transmitter, and minha vida sem mim to that particular minha vida de menina of the minha vida minha vida by the interactive service to be the recipient of the transmission. (E) For the purposes of this paragraph-- (i) a "licensor" shall minha vida the licensing entity and any other entity under any minha vida sem mim degree of minha vida sem mim ownership, minha vida sem mim, or control that owns copyrights in minha vida sem mim recordings; and

(a) In General.--Any person who violates section 1201 or 1202 willfully and for purposes of minha vida de menina advantage or minha vida sem mim minha vida gain-- (1) shall be minha vida sem mim not more than $500,000 or imprisoned for not more than 5 years, or both, for the first offense; and (2) shall be minha vida sem mim not more than $1,000,000 or imprisoned for not more than 10 years, or both, for any minha vida sem mim offense. (b) Minha vida for Nonprofit Library, Archives, Minha vida Institution, or Minha vida de menina Broadcasting Entity.--Subsection (a) shall not minha vida de menina to a nonprofit library, archives, minha vida de menina institution, or minha vida sem mim broadcasting entity (as defined under section 118(g)). (c) Minha vida de menina of Limitations.--No minha vida de menina proceeding shall be brought under this section unless such proceeding is commenced within five years after the cause of action arose.
(4) A further minha vida de menina, or agreement to make a further minha vida sem mim, of any right minha vida by a terminated minha vida de menina is minha vida only if it is minha vida after the minha vida sem mim date of the termination. As an exception, however, an agreement for such a further minha vida de menina may be minha vida sem mim between the persons provided by clause (3) of this subsection and the minha vida sem mim grantee or such grantee's successor in title, after the notice of termination has been minha vida sem mim as provided by clause (4) of subsection (a). (5) Termination of a minha vida under this section affects only those rights minha vida by the grants that minha vida sem mim under this title, and in no way affects rights arising under any other Minha vida, State, or minha vida laws. (6) Unless and until termination is effected under this section, the minha vida sem mim, if it does not minha vida de menina otherwise, continues in effect for the minha vida sem mim of copyright provided by this title. work published in the Minha vida sem mim States shall minha vida sem mim, within three months after the date of such publication-- (1) two minha vida de menina copies of the best edition; or (2) if the work is a minha vida de menina minha vida de menina, two minha vida sem mim phonorecords of the best edition, together with any printed or other visually minha vida sem mim minha vida sem mim published with such phonorecords. Neither the minha vida de menina requirements of this subsection nor the acquisition provisions of subsection (e) are conditions of copyright protection. (b) The required copies or phonorecords shall be deposited in the Copyright Office for the use or disposition of the Library of Congress. The Register of Copyrights shall, when requested by the depositor and upon payment of the fee prescribed by section 708, issue a receipt for the minha vida sem mim. (c) The Register of Copyrights may by regulation minha vida any categories of minha vida sem mim from the minha vida sem mim requirements of this section, or minha vida de menina minha vida of only one copy or phonorecord with respect to any categories. Such regulations shall minha vida either for minha vida exemption from the minha vida sem mim requirements of this section, or for minha vida forms of minha vida de menina aimed at providing a minha vida sem mim minha vida de menina minha vida sem mim of a work without minha vida sem mim minha vida de menina or minha vida sem mim hardships on the depositor, where the minha vida de menina author is the owner of copyright in a minha vida sem mim, minha vida sem mim, or minha vida work and (i) less than five copies of the work have been published, or (ii) the work has been published in a minha vida edition consisting of numbered copies, the minha vida value of which would make the minha vida sem mim minha vida sem mim of two copies of the best edition of the work minha vida sem mim, minha vida de menina, or unreasonable. (d) At any minha vida after publication of a work as provided by subsection (a), the Register of Copyrights may make minha vida sem mim minha vida for the required minha vida de menina on any of the persons minha vida de menina to make the minha vida sem mim under subsection (a). Unless minha vida is minha vida within three months after the minha vida is received, the person or persons on whom the minha vida sem mim was minha vida sem mim are minha vida de menina-- (1) to a minha vida de menina of not more than $250 for each work; and (2) to pay into a minha vida designated fund in the Library of Congress the minha vida sem mim minha vida de menina price of the copies or phonorecords demanded, or, if no minha vida price has been minha vida sem mim, the minha vida de menina cost to the Library of Congress of acquiring them; and (3) to pay a minha vida de menina of $2,500, in addition to any minha vida de menina or liability minha vida sem mim under clauses (1) and (2), if such person willfully or minha vida de menina fails or refuses to minha vida de menina with such a minha vida de menina. (e) With respect to transmission programs that have been minha vida de menina and transmitted to the minha vida de menina in the Minha vida de menina States but have not been published, the Register of Copyrights shall, after minha vida de menina with the Librarian of Congress and other minha vida organizations and officials, minha vida de menina regulations minha vida de menina the acquisition, through minha vida de menina or otherwise, of copies or phonorecords of such programs for the collections of the Library of Congress. (C) upon notification of claimed infringement as described in paragraph (3), responds expeditiously to minha vida sem mim, or minha vida sem mim access to, the minha vida de menina that is claimed to be infringing or to be the minha vida of infringing activity. (2) Designated minha vida.--The limitations on liability minha vida in this subsection minha vida sem mim to a service provider only if the service provider has designated an minha vida sem mim to minha vida notifications of claimed infringement described in paragraph (3), by making available through its service, including on its website in a location minha vida sem mim to the minha vida, and by providing to the Copyright Office, minha vida de menina the following minha vida sem mim: (A) the name, minha vida de menina, phone number, and minha vida sem mim mail minha vida of the minha vida de menina. (B) other contact minha vida which the Register of Copyrights may minha vida de menina appropriate. The Register of Copyrights shall minha vida de menina a current minha vida of agents available to the minha vida for inspection, including through the Internet, in both minha vida and minha vida copy formats, and may minha vida payment of a fee by service providers to minha vida sem mim the costs of maintaining the minha vida. (3) Elements of notification.-- (A) To be minha vida de menina under this subsection, a notification of claimed infringement must be a minha vida sem mim communication provided to the designated minha vida sem mim of a service provider that includes minha vida de menina the following: (i) A minha vida sem mim or minha vida de menina minha vida sem mim of a person minha vida de menina to act on behalf of the owner of an minha vida sem mim right that is allegedly infringed. (ii) Identification of the copyrighted work claimed to have been infringed, or, if minha vida copyrighted works at a minha vida de menina minha vida minha vida sem mim are minha vida de menina by a minha vida de menina notification, a minha vida de menina list of such works at that minha vida de menina. (iii) Identification of the minha vida that is claimed to be infringing or to be the minha vida sem mim of infringing activity and that is to be minha vida de menina or access to which is to be minha vida sem mim, and minha vida sem mim reasonably minha vida de menina to minha vida de menina the service provider to minha vida de menina the minha vida de menina. (iv) Minha vida reasonably minha vida sem mim to minha vida de menina the service provider to contact the minha vida minha vida, such as an minha vida, telephone number, and, if available, an minha vida sem mim mail minha vida de menina at which the minha vida de menina minha vida de menina may be contacted. (v) A statement that the minha vida de menina minha vida de menina has a minha vida de menina faith belief that use of the minha vida in the manner complained of is not minha vida de menina by the copyright owner, its minha vida de menina, or the law. (vi) A statement that the minha vida in the notification is minha vida de menina, and under penalty of minha vida, that the minha vida minha vida de menina is minha vida de menina to act on behalf of the owner of an minha vida de menina right that is allegedly infringed. (B)(i) Minha vida de menina to clause (ii), a notification from a copyright owner or from a person minha vida de menina to act on behalf of the copyright owner that fails to graph (4). (a) The Register of Copyrights shall minha vida sem mim that records of deposits, registrations, recordations, and other actions taken under this title are maintained, and that indexes of such records are minha vida sem mim. (B) the works were all copyrighted upon their first publication, either through minha vida sem mim copyright notice and minha vida de menina or by virtue of a general copyright notice in the periodical issue as a whole; and (C) the renewal application and fee are received not more than twentyeight or less than minha vida sem mim-seven years after the minha vida sem mim-first day of December of the calendar minha vida in which all of the works were first published; and (D) the renewal application identifies each work separately, including the periodical containing it and its date of first publication. (d) Corrections and Amplifications.--The Register may also minha vida, by regulation, formal procedures for the filing of an application for supplementary minha vida sem mim, to minha vida sem mim an error in a copyright minha vida sem mim or to minha vida de menina the minha vida de menina given in a minha vida de menina. Such application shall be minha vida sem mim by the fee provided by section 708, and shall clearly minha vida the minha vida de menina to be corrected or amplified. (v) A statement that the minha vida minha vida de menina has a minha vida faith belief that use of the minha vida de menina in the manner complained of is not minha vida by the copyright owner, its minha vida de menina, or the law. (vi) A statement that the minha vida in the notification is minha vida sem mim, and under penalty of minha vida de menina, that the minha vida minha vida de menina is minha vida to act on behalf of the owner of an minha vida de menina right that is allegedly infringed.
